A Sudanese refugee assessed by MI5 as a "committed Islamist terrorist" today won the latest stage of a legal fight with Home Secretary Theresa May after being excluded from the UK and deprived of British citizenship.

The Court of Appeal ruled that the man's case should be re-examined, following a hearing in London.

He had challenged a decision by the Special Immigration Appeals Commission (SIAC) not to allow him more time to appeal against Mrs May's decision to deprive him of British citizenship.

Three appeal judges said he should have been given more time to appeal against Mrs May's decision and ordered SIAC to re-examine the case.

Appeal judges heard that Mrs May had waited until the man was temporarily abroad before informing him of her decision after being told by security experts that such an approach would be the best way of "disrupting the risk" he posed and keeping him out of the UK.

But appeal judges said that approach had created difficulties in notifying the man of the decision and made it harder for him to lodge an appeal within prescribed time limits.

One appeal judge said Mrs May had, for "understandable reasons", sought to "circumvent the obvious intent" of regulations relating to notification.

The man was not identified in a written Court of Appeal ruling.
