A wealthy entrepreneur who threw his estranged wife’s phone against a wall during a row has been banned from going to the £3.8 million family home in west London.

Gregory Mihalcheon, 52, was in the midst of a divorce from wife Andreia when he hurled the handset towards a fireplace on July 26.

She reported the incident to the police, complaining that her £15 phone case had been damaged.

At Hendon magistrates’ court yesterday, prosecutor Kate Seal dropped the case against Mihalcheon but applied for a restraining order banning him from the South Kensington home.

“The Crown would say that behaviour is harassment,” she said. “This complainant would feel far more assured.”

In her statement, Mrs Mihalcheon said: “He yanked the phone out of my hand and it was so violent I was shocked. He threw it across the room into the wall by the fireplace and the phone fell into the fireplace.”

But Mihalcheon, a director of a software publishing and financial service companies, said he was acting in self defence.

He told the court he was sleeping in the basement of the house when a row broke out at around 7.20am, but that he had not been reckless or intended to damage the phone cover.

Mihalcheon was cleared of criminal damage after the prosecution offered no evidence against him.

The court heard Mihalcheon, represented in court by David Spens QC, was in a dispute with his wife over ownership of a car when the incident happened.
