Premier League soccer club Tottenham have won the latest round of a legal fight over the long-term use of the 2012 Olympic stadium.
Two leading London football clubs want to move to the £486 million Olympic Stadium in Stratford, east London, after the games end next summer.
Earlier this year, the Olympic Park Legacy Company (OPLC) opted for a bid put forward by Championship club West Ham. However Tottenham say the decision was unfair and lawyers were given permission to mount a legal challenge.
The High Court is scheduled to rule on the case following a hearing due to start in London on October 18.
Dinah Rose QC, for Tottenham, told a preliminary High Court hearing in London that the future of the stadium was a matter of "considerable public importance".
Miss Rose said the OPLC had considered two bids: one a joint bid between Tottenham and the AEG sport and entertainment group; the second a joint bid between West Ham and the London Borough of Newham.
In February, the OPLC had said the package put forward by West Ham and Newham Council was its "preferred bid". That decision had been backed by Government ministers and London Mayor Boris Johnson - and Tottenham had been "excluded", she said.
Miss Rose said Newham Council had agreed to provide a £40 million loan to West Ham as part of the bid.
In a statement, West Ham said: "We acknowledge that the final hurdle of a judicial review against London of Borough of Newham and the OPLC in relation to West Ham United being the preferred bidder for the Olympic Stadium has been granted on a very narrow basis.
"A full hearing will take place on October 18 and we remain confident that Newham and the OPLC will be successful in defending limited points regarding the £40 million loan that would be made to the Legacy Stadium Partnership."
